Following the passing of Proposition 56, this permit will have to be obtained ahead of completing any retail sales of vaping products. The license price is set at $265 for a 12-month period, and must be renewed annually.

Which items are considered vaping products?

The new state law requires that all products containing or derived from nicotine, and any electronic devices that deliver nicotine or other vaporized liquids to the device user must obtain this authorization. This also applies to any component, part or accessory, even if it is sold separately, such as tanks and atomizers.

Any retailers caught selling the products without a valid license will face a misdemeanor citation and seizure of inventory, said the BOE.

Excise taxes will not apply to e-cigs

Excise taxes by the Cigarette and Tobacco Products Tax Law will not be imposed on these products, hence retail owners will not be required to hang on to purchase invoices or obtain these products from a BOE licensed cigarette distributor or wholesaler. However they must be in possession of a California Seller’s Permit.
